Anti-Corruption & FCPA Compliance Committee’s Breakfast Meeting

The Anti-Corruption & FCPA Compliance Committee held a breakfast meeting on 5th December 2017 at the Walmart India office in Gurgaon. Opening remarks were made by Ms. Ritika Ratti, Chairperson – Anti-Corruption & FCPA Compliance Committee, AMCHAM and Chief Ethics & Compliance Officer & Head of Anti-Corruption, Walmart India. Based on the suggestions received from members in the last meeting, AMCHAM organized an interactive discussion on ‘Due Diligence of Sub-Contractors’ and ‘How to Address Government Requests.’ Members shared their experiences in detail and best practices based on their dealings with sub-contractors/third party vendors.

The committee decided to organize monthly best practice sharing sessions as a way to aid all committee members to discuss complicated situations within the group. Members suggested their interest areas, agenda topics and speakers for the 2018 Anti-Corruption & FCPA Compliance master class, which is being planned in Mumbai.

AMCHAM’s Aviation Committee met on November 30th, 2017 at the UTC office, Gurgaon. The meeting commenced with a welcome address by Ms. Ranjana Khanna, Director General CEO, AMCHAM India, and opening remarks by Mr. Palash Roy Chowdhury, Chairman – Aviation Committee, AMCHAM and Managing Director – India, Pratt & Whitney. The committee has formed four subgroups on 1) general aviation 2) innovation 3) skill development and 4) airport infrastructure and decided to focus on these four key areas in 2018. The other topics of discussion included the top priority states that could be engaged with, taking forward the committee’s agenda and the ‘WINGS INDIA 2018,’ the flagship event on civil aviation, which has been scheduled for March 2018.

ICT Committee Meeting  

22nd November 2017

A meeting of AMCHAM’s ICT Committee was held on November 22nd, 2017 in New Delhi. The meeting was chaired by the Chairman of the Committee, Mr. Amit Sharma, Executive Vice President and President Asia, ATC India. Members discussed issues relating to the new Telecom Policy expected to be announced in 2018, M2M and cloud, telecom and IT products testing, and data privacy. Going forward, it was decided that AMCHAM would organize a roundtable discussion with DIPP and Invest India on ICT some time during the end of January/beginning February 2018. Members will be sending their inputs in advance so that the same could be forwarded to DIPP and Invest India for review and involve other concerned departments. Some of the major issues on which notes were requested from members were (i) regulatory issues, (ii) public procurement and PMA, (iii) ease of doing business, (iv) standards and testing, (v) light touch policies, and (vi) integration of future technologies. A roundtable with DIPP on specific company related issues in the ICT sector would also form part of the ICT Committee’s program.

Infrastructure and Smart Cities Committee Meeting

As many as 18 members of the AMCHAM Infrastructure and Smart Cities Committee converged at the UTC office at Gurugram for the second committee meeting in 2017. The proceedings were chaired by Mr. Arun Kumar Jain, Managing Director, Fluor Daniel and co-chaired by Mr. Samit Ray, Director, United Technologies Corporation. This meeting picked up right from the end of the previous and first committee meeting in 2017, held on 12th July. The committee members congratulated work done and the maturity attained as a close-knit and agile institution. Members admitted that this committee had begun to work as a cohesive entity owing to work done by the AMCHAM secretariat. The committee raised few pertinent points about: a) forming a caucus comprising four consulting firms and members consulting with them for clarity on RFP documents being circulated by city administrations, b) the need to convince city administrations to waive off signing joint and several liability clauses for OEMs who are not directly bidding and c) the need to highlight similar issues during the upcoming AMCHAM Smart Cities Summit 2017 on 4th December 2017 at the Ambience Leela, Gurugram.

AMCHAM’s Eastern Region hosted a roundtable discussion with visiting U.S. government official Mr. Tom Hilleary on September 21st, 2017. Mr. Hilleary, Economic Unit Chief, Office of India Affairs, U.S. Department of State in Washington, D.C., is responsible for the State Department’s efforts on a full range of U.S. – India economic, environment, science and technology, and health cooperation.  Mr. Debdas Sen, Chairman – Eastern Region, AMCHAM, welcomed Mr. Hilleary on his first visit to Kolkata. Prior to his arrival in Kolkata, Mr. Hilleary was in New Delhi to participate in bilateral discussions related to the upcoming U.S.-India Trade Policy Forum. He briefly presented the view from Washington on U.S. – India trade and investment relations.  AMCHAM members briefed him on the presence of American companies in the region and the opportunities and challenges of doing business in West Bengal and eastern India, touching on issues like availability of land, labor challenges, and the general investment climate in the region. Members also discussed challenges related to IPR protection for software products in the United States and the FATCA (Foreign Account Tax Compliance Act) requirements for American expatriates.

Defense Committee Meeting

AMCHAM’s Defense Committee held a meeting on August 25th 2017. The Ministry of Defense issued a list of FAQ’s pertaining to offsets contracts and offsets banking which was shared with members. Members discussed offset issues – retrospective applicability of offset changes, India value addition, scope of services for offset discharge, levy of penalties, offset discharge by group companies. AMCHAM’s recommendations on strategic partnership policy were also discussed. Interest on AMCHAM’s collaboration with the European Business Group (EBG) was also sought. Con-Call of Sub-Group on GST

A con-call of the sub-group on GST was organized on 27th July 2017. Mr. Atul Gupta, Senior Director, Deloitte Haskins and Sells LLP, sought members’ views on whether any issues need to be taken up with the Ministry of Finance and GST Council. It was agreed that a follow-up note on anti-profiteering would be prepared by Anita of PwC and sent to the Government. The points sent by Amazon would also be included. Mr. Bipin Sapra of EY was requested to send a note on the export of service as there were large number of issues in terms of filing/accepting of LUT. Mr. Atul Gupta checked with members when AMCHAM’s Tax Committee could organize an event on GST with the Revenue Secretary. After discussion, it was agreed that such an event should be organized post 20th September. Members of the GST Council would also be invited. It was also agreed that a meeting would be sought with Mr. Hasmukh Adhia and Chairman, CBEC.

A few members of AMCHAM’s ICT Committee led by its Chairman, Mr. Amit Sharma, Executive Vice President and President Asia, ATC India and Co-Chairman, Mr. Naveen Tandon, Director – IEA, AT&T Communication Services India Private Limited, called on Mr. R.S. Sharma, Chairman, TRAI, on 4th July 2017. Members discussed issues related to VNO. These licenses did not differentiate between B2B and B2C licenses and led to double taxation. Mr. Sharma agreed that this was a genuine problem of double taxation. Mr. Naveen Tandon would be sending a note to Mr. Sharma on multi-parenting. Members appreciated that TRAI had adopted a number of positive measures in the last few months. Members were hoping that the M2M policy will be announced soon and the cloud consultation paper, for which chambers had sent their views, would also be finalized soon.

Shaw, India Head HR of International Paper and Partner Deloitte Hyderabad met at the Office of Broadridge Financial Solutions at Hi-tech City, Hyderabad on 4th July, 2017, to discuss the way forward for the Future of Work Conference in Hyderabad.  Ms. Tanya Paul who handles the HR Committee from AMCHAM joined via conference call.

The members decided the date for the conference to be 25th October 2017 and planned various sessions to be considered for this conference.  They requested that AMCHAM work on sponsorships and confirmations for the concerned panellists. The committee continued to keep in touch via a whatsapp group.

Aviation Committee Meeting

AMCHAM’s Aviation Committee met on 3rd July 2017 in New Delhi. They decided to focus on the implementation aspects of policy framework especially with states since AMCHAM had submitted many policy recommendations for which some have been implemented in the previous union budget and recent NCAP (National Civil Aviation Policy). AMCHAM led standalone trade missions, reverse trade missions, an annual summit and events around other big aviation shows, were also discussed. The Defense Committee met on Wednesday 24th May 2017 to go over the documents submitted to the DG (Acquisition) office. A final request to all members was made for any additional items for submission/consideration. The team felt that congratulatory letters to Def Sec Mitra and DOMW Rajib Kumar Sen should be sent out immediately. AMCHAM’s Defense Committee engagement with Parliamentary Standing Committee on Defense was discussed and the team was updated about all AMCHAM upcoming meetings. Dr. Jaijit Bhattacharya, Partner, KPMG and Co-Chairman – Infrastructure and Smart Cities Committee, AMCHAM along with Ms. Ranjana Khanna, Director General CEO, AMCHAM and Mr. Debasish Roy, Program Director, AMCHAM, met Dr. Shrikar Keshav Pardeshi, Director, Prime Minister’s Office, GoI, to push forward AMCHAM’s agenda on smart cities in India. The meeting took place on 19th May at Dr. Pardeshi’s office at the PMO. During the meeting, AMCHAM pressed for an effort by the government to identify the problems faced by the Indian smart cities agenda under three heads: 1) governance and accountability issues, 2) funding issues and 3) regulatory issues. Dr. Pardeshi was open to AMCHAM detailing and quantifying such problems through the committee so that the PMO can pass it on to the Ministry of Urban Development.

Mr. Jain was of opinion that mid-size U.S. companies should come in picture and take up projects in small cities. He shared that the GoI is investing 100 billion dollars in the energy sector and also planning to set up an R&D center in Gurgaon. He invited interested U.S. companies to be part of the project. Mr. Jain also mentioned that the U.S. – India Energy Dialogue would be held in Delhi in the fall of this year. Mr. Rick Perry, U.S. Secretary of Energy would be accompanied by a business delegation across energy sectors.

During the visit of Honourable Nancy Pelosi, Minority Leader of the United States House of Representatives, and the accompanying Congressmen, an interaction was organized on 10th May 2017 to apprise them of AMCHAM member activities and outreach. Copies of the publication “The India Journey – 25 Years of India-U.S. Business Partnership” brought out by AMCHAM to commemorate its silver jubilee was presented to the visiting delegates. AMCHAM was represented by its Chairman, Mr. Pratyush Kumar, a few members of the National Executive Board, and Director General CEO, Ms. Ranjana Khanna.
