On 18th July 2018, AMCHAM’s Supply Chain and Logistics Committee organised a Learning & Sharing (L&S) Session on ‘Authorized Economic Operator’ followed by a committee meeting. The meeting commenced with opening remarks by Ms. Surabhi Wahal Regional Director – Western Region, AMCHAM, followed by welcome remarks by Mr. Kumar Kandaswami, Chairman – Supply Chain and Logistics Committee and Partner, Deloitte Touche Tohmatsu India Pvt. Ltd. As part of the committee’s L&S initiative a presentation on ‘Authorized Economic Operator (AEO) – A Tool For Efficiency In International Trade’ was made by Mr. Prashant Deshpande, Partner, Deloitte Haskins & Sells LLP and Mr. Himanshu Tewari, Partner, Deloitte Haskins & Sells LLP. The presentation highlights included benefits and features of the AEO program, stakeholders interests and AEO – readiness assessment framework. He conveyed his pleasure at the alignment and positive movement of the dialogue and informed the team of the progress being made in the ISA. HR Core Committee Meeting

The HR Core Committee Meeting was held on 12th June 2018 at the Leela Palace. Opening remarks were given by Mr. Ramkumar Ramamoorthy, Chairman – HR Committee, AMCHAM and Executive Director – India, Cognizant. He spoke about the policy issues, future of work, women in leadership roles, upskilling, capacity building, inclusion and diversity, job satisfaction and the need to build on to the culture of giving back for employees. The discussion focused on potential topics for this year and the ideal work plan moving forward. It was decided to request committee members for their suggestions on topics that interest them and accordingly 2 or 3 workstreams will be chalked out. AMCHAM’s Tamil Nadu Chapter held a breakfast meeting focussed on capacity building for CSR Managers with guest speaker Mr. Sugata Roy, Communication Specialist, UNICEF, Chennai, on Friday, June 8, 2018 at Hotel Westin Velachery, Chennai. The meeting began with a welcome to participants by Mr. Aubrey Daniels, Regional Director – Tamil Nadu Chapter, AMCHAM, who stressed the importance of CSR and stressed the enactment of the CSR component in the Indian Companies Act 2013 was path breaking. UNICEF has been partnering with the private sector entities in strengthening the CSR interventions. UNICEF’s partnership has been primarily in the areas of capacity development, innovations and knowledge management for achieving results for children. In Tamil Nadu, UNICEF has provided technical support to CSR interventions focusing on water, sanitation and hygiene (WASH), early childhood development, child nutrition and life skills development of adolescents. A small group of members from AMCHAM’s Medical Devices Committee met on 6th June, 2018 under the Chairmanship of Mr. Prabal Chakraborty, Chairman, AMCHAM Medical Devices Committee and Vice President and MD, Boston Scientific India. The group brainstormed on the agenda items which could be taken through AMCHAM platform in the coming year. Some of the agenda items discussed during the meeting included continued international outreach to neighboring countries like Bangladesh and Sri Lanka, quarterly engagement with U.S. Embassy officials, reaching out to states, interactive sessions with key government departments, etc. The meeting was attended by members from Boston Scientific, India Medtronic, 3M India, BD India and ZimmerBiomet. Northern Region Council Executive Committee Meeting

4th June 2018

A meeting of the Executive Committee of AMCHAM’s Northern Region Council (NRC) was held on 4th June 2018 in the office of ATC, Gurugram. Mr. Amit Sharma, Chairman – NRC, welcomed and requested members to give their suggestions regarding the focus of activities for NRC. Members suggested organizing training programs for various institutions on new technologies. Other topics of interest for discussion with states would be the role of FDI, AI, robotics and skill development. Mr. Vinay Pratap Singh, Deputy Commissioner & District Magistrate, Gurugam, joined the meeting and heard from members the challenges they faced while doing business in Haryana. He was open to suggestions and said that the Haryana Government had a shelf of CSR projects which could be undertaken by U.S. companies. Mr. Vivek Atray, former IAS officer and Adviser to Vibrant Advisory Services, said that he could work with AMCHAM to enhance its visibility through social media; help organize events; and enroll U.S. companies that were not members of AMCHAM.

AMCHAM’s Defense Committee members met with Ambassador Kaidanow for a candid conversation on the U.S. – India defense climate and how the two governments had invested a lot in this relationship. On 25th May 2018, the Anti-Corruption & FCPA Compliance Committee meeting took place in the Deloitte office in Gurugram. Opening remarks were made by Ms. Ritika Ratti, Chairperson – Anti-Corruption & FCPA Compliance Committee, AMCHAM and Chief Ethics & Compliance Officer & Head of Anti-Corruption, Walmart India. Mr. Sumit Makhija, Partner – Forensic and Mr. Jayant Saran, Partner – Forensic from Financial Advisory Services, Deloitte Touche Tohmatsu India LLP, gave a presentation on ‘Use of Technology to Make FCPA Compliance Effective.’ The presentation illustrated how ESI (electronically stored information), anti-bribery programs, accounting records and transactions and the role played by vendors and agents effect FCPA. Mr. Makhija stated that technology cannot be the guiding process of a company in fact it can only provide support and act as a back up to the existing systems in place. Usually companies use tracking and financial and document management systems to maintain the compliance standards, along with a check on the emails and communications, within and outside the company. Karnataka Chapter Executive Committee Meeting

9th May 2018

The AMCHAM Karnataka Chapter Executive Committee met on May 9th, 2018 at the Syniverse India office. There was a discussion on the past events, i.e., the meeting with Consular Chief Kent May and AGM in Delhi. The committee then deliberated on inducting another member in place of Mr. Munesh Mahkhija. Future events like the golf tournament were discussed. It was also decided to make a business case to the Consulate (with help from KPMG) for having a fingerprinting facility in Bengaluru. It was also decided that data should be collected from U.S. companies in Karnataka to make a presentation readily available for when congressional delegations or officials visit.

AMCHAM supported the business roundtable hosted by U.S. Embassy for the U.S. Secretary of Energy, Mr. Rick Perry on 16th April, 2018 in New Delhi. The roundtable participants included U.S. industry along with U.S. government officials. Welcome remarks were given by Ambassador Kenneth I. Juster. Secretary Rick Perry, in his opening remarks, talked about expanding the U.S. – India energy partnership through energy innovation and also emphasized that the U.S. was keen to cooperate with India in all forms of energy including nuclear, coal, oil and gas. Moderator Mr. Robert Garverick, Minister Counselor Economic Affairs and Environment, Science and Technology, U.S. Embassy, commenced the roundtable discussion and invited representatives from industry to present an overview on the opportunities and challenges that U.S. companies face in India and how it hinders the expansion of this partnership. Agriculture and Food Processing Core Committee Meeting

The core committee of AMCHAM’s Agriculture and Food Processing Committee met under the chairmanship of Mr. Siraj Azmat Chaudhry at the Cargill office on March 28th, 2018. The co-chairs  of the committee, Ms. Neelima Dwivedi from Pepsico and Mr. Raju Kapoor from Corteva, were present. It was decided that the committee should concentrate on objectives that are unique to AMCHAM and not replicate what the other business chambers were doing and highlighted that AMCHAM was the only chamber which worked actively with the U.S. Embassy. Since AMCHAM was the sole chamber representing American companies while other chambers represented all business entities in India, the core committee concluded to start off with activities that are peculiar to and generic to American companies specifically. The Chairpersons agreed that the committee should have a mission statement that covers seed companies, pre-harvest companies, post-harvest companies, food processing and finally packaging and marketing companies. The pros and cons of a pilot projects were discussed. Grant Thornton discussed the knowledge paper the committee plans to bring out and requested inputs.

Infrastructure and Smart Cities Committee Meeting

Members of AMCHAM’s Infrastructure and Smart Cities Committee met under the chairmanship of Mr. Arun Kumar Jain, Managing Director, Fluor Daniel India, on 26th March at the office of Fluor Daniel. The meeting was co-chaired by Dr. Jaijit Bhattacharya, Partner, KPMG and Mr. Samit Ray, Director, Government Affairs, United Technologies Corporation. Since the last committee meeting, Mr. Sameer Jain, Director, Smart Cities, KPMG, shared the smart city proposals and their specifications. Members animatedly discussed the restrictions U.S. companies were operating within, what was holding them back from bidding or participating in any other manner in the contracts for smart cities, the concept of open loop standards for payments in smart cities and difficulties in obtaining licenses. The committee felt that Indian companies do not bother about scope of liability when they sign the contracts. It was decided to send representations for this issue to the Ministry. It was recommended to reach out to the cities of Ajmer and Allahabad for contracts.

CSR Committee Meeting

AMCHAM’s CSR Committee met under the Chairmanship of Mr. Harish Krishnan, Manging Director, Public Affairs & Strategic Engagement, India & SAARC, Cisco Systems (India) on March 19th, 2018 at the Cisco office in Gurugram. The purpose of the meeting was to brainstorm and plan a full day CSR event with cross-sectoral panel discussions aimed at identifying and addressing challenges, needs and avenues for capacity building in CSR. It was decided the event would be held on May 15th in New Delhi and bring together all relevant stakeholders — corporates, NGOs, social and developmental agencies and the government.

CEOs Interaction with Mr. Vijay Gokhale, Foreign Secretary, MEA

Prior to his U.S. visit, the CEOs interaction was organized with the Foreign Secretary to update him on the U.S.-India economic partnership on March 13th, 2018. He was briefed on the current scenario and the challenges faced by U.S. industry across sectors. Defence was particularly highlighted due to the forthcoming 2+2 Dialogue to be held in Washington D.C. in April. He was accompanied by Mr. Munu Mahawar, Joint Secretary (Americas) and Dr. Rajesh Ranjan, Director (Americas). The Foreign Secretary thanked AMCHAM for arranging the interaction and suggested that this should be a regular feature to keep him apprised on developments. He offered to take up various issues raised by AMCHAM with the concerned Ministries.

Anti-Corruption & FCPA Compliance Core Committee Meeting

On 13th March 2018, the Anti-Corruption & FCPA Compliance Core Committee Meeting took place at the Coca-Cola office in Gurugram. The opening remarks were given by Ms. Ritika Ratti, Chairperson – Anti-Corruption & FCPA Compliance Committee, AMCHAM and Chief Ethics & Compliance Officer & Head of Anti-Corruption, Walmart India. There was an interactive discussion on the following topics: control mechanisms that can be implemented for CSR activities in India to avoid risk under FCPA or anti-corruption laws, contributory factors for India being ranked 81 in the Global Corruption Perceptions Index in 2017 vs. 79 in 2016, increasing regulatory scrutiny of bribery and corruption – is it a media hype or actual execution at the ground level, parent-subsidiary liability under FCPA, internal audits and/or internal action initiated for contravention of compliance policies/directives and how youth in India can play an important role in building a corruption-free country. Members decided that the Anti-Corruption & FCPA Masterclass 2018 should be hosted in August. The committee would begin work towards the agenda and logistics in the next meeting.

Ask the Consultant: Infrastructure and Smart Cities Committee Meeting

On 12th March, AMCHAM’s Infrastructure and Smart Cities Committee, under the leadership of Mr. Samit Ray, Co-Chairman – Infrastructure and Smart Cities Committee, AMCHAM and Director, Government Affairs, United Technologies Corporation, organized a session with consultants to address challenges that members faced regarding smart cities. American consulting firms have been appointed by Indian Smart City SPVs as their Project Management Consultants (PMCs), however, American companies have not been able to make much progress since the smart cities mission has been launched. The panel of experts from consulting firms who advised member companies and members from the U.S. Embassy discussed the short comings in the RFPs, contracts, appendices etc. Mr. Amit V. Singh from PWC, Mr. Sameer Jain from KPMG, Mr. Anil Kumar from CH2M Hill and Mr. Puneet Randeo from Underwriter Laboratories formed a panel of consultants to advise members on hitches experienced during the procurement process in India’s smart cities and infrastructure space.

AMCHAM India, in association with Strategy Execution and Duke Corporate Education, conducted an exclusive workshop on “Design Thinking in a VUCA World” in Bengaluru, on 7th March 2018, at the J.W. Marriott. The speakers included Mr. Nikhil Raval, Managing Director, Duke CE and Mr. Ajay Parasrampuria, Design Thinker. The key takeaway was an overview of how to deploy design thinking for results in today’s VUCA (volatile, uncertain, complex and ambiguous) world.  The speakers talked about how to (i) jump-start an innovation culture; (ii) visualize new or improved product and services that a company could offer; and (iii) make the offering more desirable, feasible, viable and dependable. The participants gained an understanding of executing strategy through design thinking in a VUCA environment; customer focused thinking and re-framing of what one sees; leading a collaborative process for ideation and innovation; and pitching, informing and improving ideas for success.

On February 21st 2018, a Defense Committee meeting was held at the BAE Systems India office. The meeting was chaired by Mr. Phil Shaw, Chairman – Defense Committee, AMCHAM and Chief Executive, Lockheed Martin India and Mr. Michael Koch, Co-Chairman – Defense Committee, AMCHAM and Vice President – South Asia, International Business Development, Boeing International Corporation. Members were briefed on the meetings with Mr. Rajib Kumar Sen, Economic Advisor and In-Charge DOMW and Mr. Apurva Chandra, DG (Acquisition), MoD. Economic Affairs Committee Meeting

The first meeting of AMCHAM’s Economic Affairs Committee was held on February 20th 2018, in Gurgaon under the chairmanship of Mr. Nitin Atroley, Chairman – Economic Affairs Committee, AMCHAM and Office Managing Partner Delhi, KPMG in India. Members brainstormed on the agenda for 2018 – 2019. Some of the topics discussed included trade, tariffs, capital markets, investment promotion, healthcare infrastructure, electric vehicles, aadhaar card challenges, ease of doing business and the insolvency bankruptcy code. The committee decided to create a survey for AMCHAM members on ease of doing business.

Eastern Region Executive Committee Meeting

Mr. Debdas Sen, Chairman – Eastern Region, AMCHAM, chaired the Executive Committee meeting on February 20th, 2018 in Kolkata.  The focus of the meeting was forthcoming events through April 2018.  He also updated members on events that the region had hosted or participated in since the last meeting held in November 2017. He said the region had done a record number of high level focused events and that all the events were very well attended. He mentioned the signature event on inclusive growth with the former President of India, Dr. Pranab Mukherjee, Annual Get-Together where a number of IAS officers and IPS officers attended provided members an opportunity to interactive with government officials in a social setting, the Bengal Global Business Summit and U.S. Ambassadors interactive session with AMCHAM members, in partnership with BCCI, which received wide media coverage.  He also updated members on the session AMCHAM organized in partnership with the ICT Division of the Government of Bangladesh on February 15th, 2018.  He said that this was the first time that the region had hosted an event of this nature and said that member companies who participated found it very helpful and useful. The ‘On the Spot Budget Analysis 2018’ was also held.

Budget Connect

AMCHAM organized ‘Budget Connect’ in association with Ernst & Young at the Westin on February 2nd, 2018.  There was a presentation on two major points: direct tax proposals which included individual tax proposals, changes and benefits; measures to stimulate growth – promotion of start-ups, levy of distribution tax, long term capital gain etc.; proposals to generate revenues which touched on commodity transaction taxation, digital economy taxation etc. and rationalization measures.
